WAIVER AND RELEASE OF LIABILITY
This Waiver and Release of Liability (“Agreement”) is entered into by the individual agreeing to these terms (“Participant”) in favor of The Beta Angel Project, LLC, a Colorado limited liability company (“Company”).
By agreeing to this waiver, you acknowledge and agree to the following:
1. SCOPE OF ACTIVITIES
This Agreement applies to all services provided by the Company, including but not limited to:
- Climbing activities (indoor and outdoor)
- Training on home walls or gym facilities
- Strength and conditioning programs
- Movement analysis and skill development (MoveSci programs)
- Video analysis services (including use of third-party platforms such as OnForm)
- Live, remote, or in-person coaching (including gyms and competitions)
- General guidance related to performance, including nutrition and sport psychology
2. ASSUMPTION OF RISK
I acknowledge that climbing and physical training activities involve inherent risks, including but not limited to:
- Falls, equipment failure, and environmental hazards
- Physical exertion, overuse, or improper technique
- Serious injury, permanent disability, or death
I voluntarily assume full responsibility for all risks, known or unknown, associated with participation in any activities, programs, or services provided by the Company.
3. LIMITED OBSERVATION AND APPLICATION OF ADVICE
I understand that:
- Video analysis and remote coaching are based on limited observation
- The Company may not have full knowledge of my physical condition, environment, fatigue, or prior injuries
I accept full responsibility for how I interpret and apply any recommendations, exercises, or advice provided.
4. MEDICAL AND HEALTH DISCLAIMER
I understand that the Company does not provide medical advice.
I affirm that I am physically capable of participating in training activities or have consulted a qualified healthcare professional.
I assume full responsibility for any injury, illness, or condition that may arise from participation.
I understand I am solely responsible for monitoring my physical condition during participation.
5. RELEASE OF LIABILITY
To the fullest extent permitted by law, I hereby release, waive, and discharge The Beta Angel Project, LLC, its owners, employees, contractors, and affiliates from any and all liability, claims, demands, or causes of action arising out of or related to:
- Injury, illness, or death
- Property damage or loss
- Participation in any activities, programs, or services
This includes claims arising from the negligence of The Beta Angel Project, LLC, its owners, employees, contractors, or agents, except where prohibited by law.
6. INDEMNIFICATION
I agree to indemnify and hold harmless The Beta Angel Project, LLC from any claims, damages, or liabilities arising from my participation or use of its services.
7. EMERGENCY CARE
In the event of an emergency during in-person coaching, I authorize the Company to seek medical care on my behalf if necessary. I accept full responsibility for any associated costs.
8. MEDIA RELEASE (OPTIONAL WITH CONSENT)
If I provide explicit consent, I grant The Beta Angel Project, LLC permission to use submitted video or media for educational, marketing, and promotional purposes. This may include editing, annotation, or excerpting.
I understand that:
- Use is optional and requires consent
- I may request reasonable anonymization
- I may withdraw consent for future use (not retroactive)
If I am under 18, parental or guardian consent is required.
9. MINORS
If I am signing on behalf of a minor, I confirm that I am the parent or legal guardian of the minor and agree to all terms of this Agreement on their behalf. I accept full responsibility for the minor’s participation.
10. GOVERNING LAW
This Agreement shall be governed by the laws of the State of Colorado. Any disputes shall be resolved in the state or federal courts located in Colorado.
11. SEVERABILITY
If any provision of this Agreement is found to be unenforceable, the remaining provisions shall remain in full force and effect.
12. ACKNOWLEDGMENT AND AGREEMENT
By checking the box indicating agreement to this Waiver and Release of Liability, I acknowledge that:
- I have read and fully understand this Agreement
- I agree to be legally bound by its terms
- I am at least 18 years old, or I am the parent/legal guardian signing on behalf of a minor
- My electronic acceptance constitutes a legally binding agreement equivalent to a handwritten signature
