TERMS OF USE

These Terms of Use (“Terms”) govern your use of the website, products, and services provided by The Beta Angel Project, LLC, a Colorado limited liability company (“Company,” “we,” “us,” or “our”), including MoveSci training programs and video analysis services.

By accessing this website or purchasing any products or services, you agree to these Terms.

1. SERVICES

The Company provides:

  • Digital training products (MoveSci videos and PDF training plans)
  • Video analysis services (including use of third-party platforms such as OnForm)
  • Live or remote coaching, check-ins, and occasional in-person coaching (e.g., gyms or competitions)

All services are subject to availability and may be modified at any time.

2. ELIGIBILITY

You must be at least 18 years old, or have permission from a parent or legal guardian, to use our services.

3. PAYMENTS, SUBSCRIPTIONS, AND REFUNDS

  • All purchases are final and non-refundable.
  • Subscription services may be canceled with at least 3 days (72 hours) notice prior to the next billing cycle.
  • Failure to cancel within the required notice period may result in the next billing cycle being charged.

4. SERVICE DELIVERY

  • Standard video analysis turnaround: within 4 days of video submission, unless otherwise stated.
  • Expedited services: within 24 hours of video submission, if purchased.
  • Live support is provided on a near real-time basis, but response times are not guaranteed.

Delays may occur due to volume, technical issues, or circumstances beyond our control.

5. ACCESS AND PLATFORM USE

  • Video analysis services may require access through third-party platforms (e.g., OnForm), provided via email.
  • Training programs are delivered via email with links to password-protected video content and accompanying materials.
  • You are responsible for maintaining access to your email and any required applications.

We are not responsible for issues related to third-party platforms, including access, outages, or data loss.

6. INTELLECTUAL PROPERTY

All content provided by the Company, including videos, training plans, analysis, and materials, is the intellectual property of The Beta Angel Project, LLC.

  • Content is licensed for personal use only.
  • Content may not be copied, shared, distributed, reproduced, or resold without prior written permission.
  • Content may be purchased as another individual’s personal use, but may not be redistributed beyond the intended recipient.

7. USER CONTENT

If you submit videos or other materials:

  • You confirm you have the legal right to share them
  • You grant the Company permission to use them for the purpose of providing services
  • Additional usage (e.g., marketing) is governed by separate consent

8. NO COACH–ATHLETE RELATIONSHIP

Purchasing a product or service does not establish an ongoing coach–athlete relationship unless explicitly agreed upon.

9. LIMITATION OF SERVICES

  • MoveSci programs are generalized training systems
  • Video analysis is based on limited observation and context
  • Recommendations may not account for all variables (environment, history, condition)

You are responsible for how you apply any information provided.

10. TERMINATION

We reserve the right to:

  • Refuse service
  • Suspend or terminate access
  • Cancel services

at our discretion, including for misuse, violation of these Terms, or inappropriate conduct.

11. DISCLAIMER AND LIABILITY

Your use of this website, products, and services is subject to our Disclaimer.

To the fullest extent permitted by law, The Beta Angel Project, LLC is not liable for:

  • Injuries or damages arising from training or climbing activities
  • Loss of data, access, or service interruptions
  • Any direct, indirect, incidental, or consequential damages

12. GOVERNING LAW

These Terms are governed by the laws of the State of Colorado, without regard to conflict of law principles.
Any disputes shall be resolved in the state or federal courts located in Colorado.

13. CHANGES TO TERMS

We may update these Terms at any time. Continued use of the website or services constitutes acceptance of the updated Terms.

15. ENTIRE AGREEMENT
